Terms of Use

1. Acceptance

By using Baby ("Service"), you agree to these Terms. If you do not agree, do not use the Service. The Service is provided by GenXis, Inc., a Delaware corporation.

2. Service Description

Baby is an AI assistant in beta testing. It generates responses based on patterns in training data. Outputs may contain errors, inaccuracies, hallucinations, or inappropriate content. Do not rely on Baby for medical, legal, financial, or other critical decisions.

3. Acceptable Use

You agree NOT to:

• Use Baby for illegal activities or to harm others
• Conduct jailbreaking, red-teaming, or adversarial attacks without written approval
• Attempt to extract training data or reverse-engineer the model
• Generate malware, spam, phishing, or deceptive content
• Impersonate others or spread misinformation
• Circumvent usage limits or access controls
• Use outputs to train competing AI models
• Resell access or use for competing platforms

4. User Responsibility

YOU ARE SOLELY RESPONSIBLE for your use of the Service and any content you generate, submit, or act upon. GenXis, Inc. is a neutral technology provider and:

• Does not endorse or assume responsibility for any user-generated content
• Is not a party to any transaction or activity you undertake using outputs
• Shall not be deemed an accomplice or participant in any illegal activity by users
• Has no duty to monitor or validate how you use AI-generated content
• Bears no liability for consequences arising from your misuse of outputs

5. No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE ACCURACY, RELIABILITY, COMPLETENESS, OR AVAILABILITY. YOU USE THE SERVICE AT YOUR OWN RISK.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GENXIS, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID IN THE PRIOR 12 MONTHS OR (B) $100 USD.

7. Indemnification

You agree to defend, indemnify, and hold harmless GenXis, Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorney fees) arising from your use of the Service, violation of these Terms, or violation of any third-party rights.

8. Access Revocation

We may suspend or terminate your access immediately, for any reason, without notice or liability. Beta credits have no cash value, expire daily, and are forfeited upon termination.

9. Arbitration

Any dispute arising from these Terms shall be resolved by binding arbitration under the rules of the American Arbitration Association. YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTIONS.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, USA. Any legal action shall be brought exclusively in Delaware state or federal courts, and you consent to personal jurisdiction therein.

11. Export Controls

You represent that you are not located in any country subject to U.S. embargo, not on any U.S. Government restricted party list (OFAC, Commerce Department), and will not use the Service in violation of export laws.

12. Intellectual Property

You retain ownership of content you input. GenXis assigns to you its rights in outputs generated for you. The Service, models, and algorithms remain the exclusive property of GenXis, Inc.

13. Account Security

You are responsible for maintaining the security of your account. Notify us immediately of unauthorized access. GenXis is not liable for losses from unauthorized account use.

14. Force Majeure

GenXis is not liable for failures due to causes beyond reasonable control, including acts of God, war, terrorism, pandemics, power outages, or third-party service disruptions.

15. General

If any provision is unenforceable, the remaining provisions continue in effect. These Terms constitute the entire agreement. We may update Terms at any time; continued use constitutes acceptance.
